Article 3 Base District Regulations/Standards

Section 9-3.9.309 Open space districts.

The parcel(s) have been designated as general open space districts (GOS) as established under the San Juan Capistrano Municipal Code. The GOS may be utilized for possible combined development of several of the uses or the individual development of one of the uses specially allowed by the other open space districts in accordance with the General Plan.

Under Section 9-3.9.309 the other open space districts are identified as:

Recreation Commercial (RC) Indoor and Outdoor Recreational Activities

Permitted and conditional uses as defined under code include churches, equestrian facilities, driving ranges, sports arenas and stadiums, and other indoor recreational facilities. Certain permitted and conditional uses may be subject to special conditions regarding location, operation, or the design of the use. Conditional uses are subject to the review requirements and conditions contained in Section 9-2.317 Conditional Use Permit.

Purchasers of the parcel(s) may seek conversion of open space uses via amendment of the General Plan, which is an entitlement process requiring public input and review, to allow development of residential unit(s). With the ocean views provided from the parcel(s) existing road, residential use has the potential to see the highest return on investment for the right buyer.
